At your initial meeting we can provide some information on costs, and our fixed fees.  When you formally instruct us we will write to you with a costs estimate tailored to the individual circumstances of your case. Then as your case progresses we provide you with regular costs information to keep you informed as to the level of costs you are incurring and are likely to incur in the future. 

 

We offer a fixed fee divorce service for most uncontested divorces.  In cases where we do not offer fixed fees, we will keep your costs to a minimum.  We will do this by:

 

  • Keeping you informed of the work required and the likely cost of this work
  • Asking for payments on account of the fees likely to be incurred and billing you on a monthly basis.  This will avoid you receiving a large bill at the end of the matter.   
  • Advising you when there is preparatory work which you could carry out, if you are willing to do so, to save us carrying it out and charging you for this.

Co-habitation disputes

There is no specific legislation that deals with disputes between unmarried couples, and these disputes can therefore be more difficult and costly to resolve.

 

What can we do?

To prevent a dispute

Disputes between unmarried couples often revolve around jointly owned property.  It is important to obtain clear legal advice on property ownership before you enter into the joint ownership of property. 

 

Unmarried couples who own property together are treated completely differently to married couples who own property together.  In a relationship breakdown unmarried couples can often be at a disadvantage. 

 

We can advise you at all stages of your relationship to ensure that your rights are protected and your obligations are considered.  In particular we can offer the following:

 

  • Declaration of trust setting out details of property ownership to protect you in the event of a relationship breakdown
  • Cohabitation agreement setting out details of who is to be responsible for payment of the mortgage, bills, maintenance and repairs, and on what basis, as well as what would happen in the event of a relationship breakdown.
  • Pre-nuptial and post-nuptial agreements.

 

What if there's a dispute?

If there is a dispute, we will advise you on your legal rights both in terms of your right of occupation and your share of the sale proceeds.

 

We will give you practical advice on all aspects of relationship breakdown and realistic outcomes, together with advice on the quickest and most efficient way of resolving the dispute. 

 

If agreement cannot be reached through negotiation, we can protect your interest by making an application to court.  We will provide you with advice and assistance throughhout the process.

We keep in mind that dealing with financial settlements during relationship breakdowns is stressful, and we try to help you achieve the best possible outcome whilst minimising the adverse effects of this difficult time.
